OCUMUN – TERMS OF USE, POLICIES, AND TERMS AND CONDITIONS
For the purposes of these terms, "Ocumun" refers to the mobile and web platform operated by Ocumun OÜ, a private limited company established under the laws of the Republic of Estonia (hereinafter referred to as the "Operator").
1. Terms of Service
Notice on Development and Feedback:
Ocumun is a platform continuously undergoing development and enhancement. While
we strive to provide the highest quality and stability of the application,
technical issues, errors, or temporary outages may occur. We highly appreciate
any reports of issues or suggestions for improvement sent to
support@ocumun.com. By submitting feedback, ideas, or suggestions, you agree
that these are provided voluntarily and without any claim for compensation or
legal entitlement. The Operator (Ocumun OÜ) reserves the right to use such
feedback freely for further development of the service.
Registration and Account Verification:
To use the Ocumun service, users must create an account. Email verification via
a confirmation link sent to the provided address is required. The account will
not be fully activated until this verification is completed. Users are
responsible for the accuracy of the information provided and for protecting
their login credentials.
Content Creation Exclusivity:
Content intended for publication on the Ocumun platform must be captured
exclusively using the Ocumun application. It is not allowed to upload photos or
videos created with other applications or the system camera. This requirement
ensures the authenticity and trustworthiness of the content. After capturing,
the record is automatically stored both in the app's storage and in the
device's standard gallery. Files in the gallery can be freely edited or shared
outside Ocumun but cannot be re-uploaded to the Ocumun platform.
Content Sharing Process:
Each submission must follow the process: capture → upload to the cloud →
publication. Content will not be publicly available until it is published by
the user.
Content Authenticity:
All records must be authentic, without edits or manipulation. Each published
record will automatically include the location and time of capture. These
details will be published alongside the post.
Content Filtering:
Ocumun allows users to filter content using filters and tags (e.g., violence,
weapons, sexual content). Users who upload content are obliged to label it
correctly. Repeated incorrect tagging may lead to warnings, account
restrictions, or even a ban.
Managing and Deleting Content:
Users can cancel the publication of their submission at any time, making it no
longer publicly accessible, but the record will remain stored in Ocumun’s cloud
storage. If the user requests full deletion of the submission, the record will
be removed from the main storage and retained only in backups for 90 days,
after which it will be permanently deleted. Profile and content management are
available through the app or via www.ocumun.com.
Interactions (Likes and Discussions):
Ocumun allows interaction with posts through likes and discussion comments.
Users agree to act respectfully and in accordance with the law. Hate speech,
insults, spam, bullying, or other inappropriate behavior is prohibited and may
result in removal of the post or blocking of the account.
Illegal and Harmful Content:
It is strictly prohibited to upload, share, or otherwise publish any content
that is in violation of the laws applicable in the user's location or under
international law. This includes, but is not limited to: child pornography,
incitement to violence, promotion of terrorism, human trafficking, hate speech
that violates the law, and copyright infringement. Violations of this rule may
result in immediate blocking or termination of the account and notification of
the relevant authorities.
Content that depicts violence, erotica, or other sensitive materials, which is not itself illegal, must be properly tagged during upload to allow filtering by other users.
Violation of Rules and Sanctions:
The Operator (Ocumun OÜ) reserves the right to suspend, block, or permanently
terminate a user account in the event of a violation of the Terms of Service,
Community Guidelines, laws, or other service rules. This action may be taken
without prior notice. In the case of account termination due to a violation of
the rules, the user is not entitled to compensation or a refund of payments.
Responsibility for Account:
Users are responsible for protecting their login credentials. In case of
suspected misuse, users must immediately contact support.
Updates to Terms:
The Operator (Ocumun OÜ) reserves the right to update these terms at any time.
Users will be informed of changes when launching the application after the
terms are updated.
2. Privacy Policy
Data Collection:
We collect personal data that you provide during registration (e.g., name,
email address, age) as well as technical data about the use of the application
(IP address, device type, cookies). We automatically collect and publish the
location and time of capture for each submission.
Purpose of Processing:
Your personal data is processed solely for the purpose of operating, securing,
and managing the Ocumun platform. Location and time data are a mandatory part
of published submissions and cannot be removed.
User Rights:
You have the right to:
• request access to your personal data,
• request correction of inaccurate data,
• request the erasure of personal data (“right to be forgotten”),
• request restriction of processing,
• object to processing,
• lodge a complaint with a supervisory authority.

Data Retention:
We retain your data only for as long as is strictly necessary to fulfill the
purposes for which it was collected. Submissions deleted by the user remain in
backups for 90 days before being permanently deleted.
Security:
We implement technical and organizational measures to protect your data against
unauthorized access, loss, or misuse.
Data Sharing:
We do not share your data with third parties, except as required by law or with
technical partners necessary for the operation of the platform.
3. End User License Agreement (EULA)
License:
The Operator (Ocumun OÜ) grants you a non-exclusive, non-transferable, and
revocable license to use the application solely for personal, non-commercial
purposes. This license is unlimited in time but will automatically terminate if
the user account is canceled or if these terms are violated. The license applies
solely to the application itself and its functions.
Content (such as photos or videos) captured through the application may be offered for sale by the user within the Ocumun platform. Buyers, including media outlets and other entities, acquire the right to use the purchased content. This includes the right to use it for commercial media purposes, in accordance with the applicable terms of sale. Ocumun does not guarantee exclusivity of purchased content unless explicitly stated otherwise.
Restrictions:
The user may not copy, modify, distribute, reverse engineer, or use the
application or any part of it to create derivative works. Any attempts to
bypass the technical protection measures of the application are strictly
prohibited.
Ownership:
All rights to the Ocumun application, including source code, design, databases,
and trademarks, remain the exclusive property of Ocumun OÜ (the Operator). The
granted license does not constitute a transfer of any ownership rights.
Liability:
The application is provided “as is” without any express or implied warranties. The
Operator (Ocumun OÜ) shall not be liable for any direct or indirect damages,
data loss, loss of profit, or other harm arising in connection with the use or
inability to use the application.
4. Community Guidelines / Code of Conduct
Authenticity:
Each user is required to upload only authentic content – without any edits,
manipulations, or staged material. The Ocumun platform is intended for truthful
capturing of reality; therefore, it is prohibited to deliberately create or
present content that is misleading or abuses the trust of others. Each post is
automatically supplemented with the time and precise location of capture upon
publication.
Respect and Safety:
It is prohibited to publish offensive, hateful, discriminatory, or otherwise
harmful content on the platform, including bullying, harassment, threats,
unsolicited advertising (spam), and violations of the rights of others (e.g.,
privacy or personal rights).
Content Tagging:
Every post must be properly tagged when uploaded, especially if it contains
sensitive or potentially harmful content (e.g., violence, erotica, weapons,
accidents). These tags allow other users to utilize the filtering function.
Repeated or intentional mislabeling of content may result in account
restrictions or blocking.
Harmful and Illegal Content:
Content that violates applicable laws or the service’s terms is prohibited. A
detailed definition of such content is provided in the article “Illegal and
Harmful Content.” The Operator (Ocumun OÜ) reserves the right to remove such
content and, if necessary, contact the relevant authorities.
Reporting Violations:
Users can report violations of these guidelines directly via in-app reporting
features. Reported content may be temporarily hidden during review. The
Operator (Ocumun OÜ) reserves the right to remove content, issue warnings,
temporarily suspend, or permanently terminate the account of a user who
violates the rules.
5. Cookie Policy
The Ocumun application uses cookies exclusively to ensure the basic functionality of the service and to secure the application. These cookies include:
• Technical (necessary) cookies : which enable the basic operation of the app’s functions (e.g., login, saving user preferences).
• Security cookies : which protect the account and prevent unauthorized access.
We do not use cookies for targeted advertising, analytics, or tracking users outside our platform.
As these are exclusively technically necessary cookies, their use does not require your consent; however, we inform you about their use during the first installation or launch of the application. If you choose to block these cookies through your device settings, some functions of the application may not work properly.
6. Consent at Registration
When registering a user account, the user must explicitly confirm the following consents:
• ✅ I agree to the Terms of Service of Ocumun.
• ✅ I agree to the Privacy Policy.
Without granting these consents, it is not possible to create an account.
Optionally, the user may also give the following consent:
• ✅ I agree to receive marketing communications (e.g., news, special offers, service updates).
This consent is not a condition for registration and can be withdrawn at any time via account settings or upon request.
7. Terms and Conditions
Paid Services
Each registered user is provided with free storage space of 2 GB. Increasing
the available space is possible through a paid service according to the current
offer published in the application or on the website www.ocumun.com. Payment for the service is made by transfer to the account of The
Operator (Ocumun OÜ). The paid service is activated immediately upon receipt of
payment to the operator’s account.
Sale of Submissions
The Operator (Ocumun OÜ) allows users to offer submissions (photos, videos
captured via the app) for sale to other registered users, including media
entities.
Sales Terms:
• The user confirms that they have full rights to the content and that the submission is authentic and captured exclusively using the Ocumun application.
• The Operator (Ocumun OÜ) charges a commission of 15% of the final sale price.
• Payment from the buyer is first sent to the account of the Operator (Ocumun OÜ).
• The payout to the seller will be made within 10 business days of receiving payment from the buyer.
• The minimum payout amount is 20 EUR. Amounts below this limit will be recorded in the user’s profile and accumulated for the next payout. Payment will be made once the accumulated amount reaches or exceeds the minimum limit of 20 EUR.
• The Operator (Ocumun OÜ) reserves the right to require identity or bank account verification before payment is made.
• The Operator (Ocumun OÜ) is not responsible for non-payment by the buyer; in such cases, the seller is not entitled to receive payment.
• The sale of the submission is final, except in cases of technical errors or non-delivery of content.
• The user is responsible for ensuring compliance with tax and accounting obligations related to income from sales.
Jurisdiction
The Ocumun service is operated by Ocumun OÜ, a company registered in the
Republic of Estonia. All legal relationships between the user and the Operator
are governed by Estonian law. Any disputes will be resolved by the competent
courts of Estonia.
Invoicing
Invoices for paid services can be requested via email at support@ocumun.com.
The invoice will be issued based on the information provided by the user.
